1. Acceptance of the Terms

These Terms govern your access to and use of the Tokshield website, application, and any related tools, content, or features. Your use of the Service constitutes your acceptance of these Terms as well as any additional policies or notices referenced here.

2. Eligibility

You may use the Service only if: (a) you are at least 18 years old (or the age of majority in your jurisdiction, if higher); (b) you have the legal capacity to enter into a binding agreement; and (c) your use of the Service is not prohibited by applicable laws, regulations, or sanctions. By using the Service, you represent and warrant that these conditions are met.

3. No Financial, Investment, Legal or Tax Advice

Tokshield provides informational risk scores, metrics, labels, checklists, and other analytics only. Nothing on or through the Service constitutes financial, investment, trading, legal, tax, or other professional advice. Tokshield is not a broker, financial advisor, investment advisor, portfolio manager, legal advisor, tax advisor, or a regulated financial institution.

You are solely responsible for your own research, decisions, and actions. You must not rely solely on the Service to make any decision regarding the purchase, sale, holding, transfer, or use of any digital asset, token, or other financial instrument. Before making any financial or investment decision, you should consult with appropriately qualified professionals.

4. High-Risk Nature of Digital Assets and DeFi

Digital assets, cryptocurrencies, tokens, and decentralized finance (DeFi) protocols are highly speculative and involve significant risks, including but not limited to extreme price volatility, partial or total loss of funds, smart contract vulnerabilities, liquidity issues, market manipulation, regulatory changes, and other operational or technological risks.

By using the Service, you acknowledge and accept these risks. You understand that you can lose some or all of the value of any assets you decide to buy, sell, hold, or interact with, and that all such decisions are entirely your own responsibility.

5. No Warranty; Service Provided “As Is”

The Service is provided on an “as is” and “as available” basis, without any warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, Tokshield disclaims all warranties, express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Tokshield does not represent or warrant that the Service will be accurate, complete, reliable, up to date, error-free, uninterrupted, secure, or free of harmful components, or that any defects will be corrected. Scores, metrics, and other outputs are inherently uncertain and may be incomplete, incorrect, or inappropriate for your particular use.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Tokshield and its owners, founders, directors, employees, contractors, partners, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of, inability to use, or reliance on the Service.

This includes, without limitation, any loss or damage resulting from: (a) any decision you make based on information provided by the Service; (b) any interaction you have with digital assets, tokens, protocols, smart contracts, or third-party services, even if discovered or accessed through the Service; (c) any technical failure, error, interruption, or security issue affecting the Service or the underlying networks.

If, notwithstanding the above, Tokshield is found to have any liability to you, Tokshield’s total cumulative liability shall not exceed the amount you have paid (if any) to Tokshield for access to the Service in the twelve (12) months preceding the event giving rise to the claim, or one hundred (100) US dollars (or equivalent), whichever is lower.

7. User Responsibilities

You are solely responsible for your wallets, private keys, seed phrases, passwords, and security practices. Tokshield does not have access to your private keys and cannot recover lost keys, passwords, or funds. You remain fully responsible for securing your devices and accounts.

You are also responsible for ensuring that your use of the Service complies with all applicable laws, regulations, and rules in your jurisdiction and for any content, data, or information you provide through the Service.

8. Third-Party Services and Links

The Service may reference, display, or link to third-party protocols, smart contracts, websites, APIs, wallets, or other services. Tokshield does not control and is not responsible for any third-party services and does not endorse or guarantee their security, functionality, legality, or suitability.

Interacting with any third-party service is entirely at your own risk. Any issues or claims concerning third-party services must be handled directly with the relevant third party.

9. Changes to the Service

Tokshield may modify, suspend, or discontinue all or part of the Service at any time without prior notice. This includes, without limitation, changes to scores, algorithms, data sources, features, or visualizations. Tokshield shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10. Changes to These Terms

Tokshield may update these Terms from time to time. When this occurs, the “Terms of Use” page will be updated. By continuing to use the Service after any changes become effective, you agree to be bound by the revised Terms. If you do not agree with the revised Terms, you must stop using the Service.

11. Compliance With Laws

You are solely responsible for determining whether your use of the Service is lawful in your jurisdiction and for complying with all applicable laws, regulations, and rules. Tokshield makes no representation that the Service is appropriate or available for use in all locations.

12. Indemnification

You agree to indemnify, defend, and hold harmless Tokshield and its owners, founders, directors, employees, contractors, partners, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.

13. Termination

Tokshield may, at its sole discretion and without prior notice, suspend or terminate your access to all or part of the Service, for any reason, including if Tokshield reasonably believes that you have violated these Terms or engaged in unlawful, abusive, or fraudulent activity. Upon termination, your right to use the Service will immediately cease.

Provisions of these Terms that by their nature should survive termination shall continue to apply, including, without limitation, sections related to no advice, no warranty, limitation of liability, user responsibilities, third-party services, indemnification, and severability.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be enforced to the maximum extent permitted, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and Tokshield regarding your use of the Service and supersede any prior or contemporaneous understandings, agreements, or communications relating to the subject matter hereof.

16. Tokens and Future Token

From time to time, Tokshield may reference or be associated with one or more tokens or a future token related to the project. Nothing on or through the Service constitutes an offer to sell, a solicitation of an offer to buy, or a recommendation to acquire or dispose of any token or other asset. Tokshield does not guarantee that any token will be launched, maintained, hold any particular value, provide any utility, or be available on any exchange or platform.

Any reference to a current or future token is strictly informational. You must do your own research (“DYOR”) and make your own independent assessment before interacting with any token. You acknowledge that Tokshield makes no commitment or promise regarding the timing, structure, rights, economics, governance, listing, availability, or regulatory status of any token now or in the future, and Tokshield shall have no responsibility or liability for any loss, cost, or damage arising from your interaction with any token.

17. Roadmap and Future Features

From time to time, Tokshield may publish or display a roadmap, timeline, or description of planned phases, features, or releases (the "Roadmap"). The Roadmap is provided for general, illustrative and informational purposes only.

The Roadmap does not constitute a commitment, guarantee, or promise by Tokshield to deliver any specific feature, product, integration, token utility, or milestone, nor to deliver them in any particular order or within any particular timeframe. Tokshield may modify, postpone, reorder, or cancel any part of the Roadmap at any time and without prior notice.

You should not rely on the Roadmap when making any financial, trading, investment, or other decisions. Any references to future features, phases, or developments are forward-looking and inherently uncertain, and Tokshield shall have no liability for any loss, expectation, or decision that relies on the Roadmap or on any forward-looking statements.
